Terms of Service

Draft last updated November 4, 2026.

DRAFT — PENDING LEGAL REVIEW. These terms are published so the product, its rules, and its limits can be reviewed before a live launch. They are not legal advice and are not final launch terms.
Current build: demo mode. Balances, deposits, packs, cards, sell-back credits, shipping charges, and other values shown in this build are simulated test values. They have no monetary value and do not create a right to money or to a physical card.

1The agreement

These Terms of Service (the “Terms”) govern your access to and use of THE VAULT, including its websites, applications, digital pack openings, account features, and fulfillment services (together, the “Service”). By creating an account, purchasing or opening a pack, redeeming a code, or otherwise using the Service, you agree to these Terms and to our Privacy Policy.

We may update these Terms. For a material change, we will provide notice through the Service or by another reasonable method before the change takes effect when required by law. Continuing to use the Service after an update takes effect means you accept the updated Terms.

2Eligibility and accounts

  • You must be at least 18 years old and the age of majority in the jurisdiction from which you access the Service.
  • You may maintain only one account. You may not share, sell, transfer, or allow another person to operate your account.
  • Information you provide must be accurate, current, and complete. You are responsible for activity under your account and for keeping your sign-in credentials secure.
  • We may require identity, age, address, tax, payment-ownership, or source-of-funds verification before allowing an account, purchase, shipment, or other transaction. Failure to complete a lawful verification may restrict or end access to affected features.
  • The Service is offered only in the United States, and physical cards may be shipped only to eligible U.S. domestic addresses.
  • You may not use the Service if you are barred by applicable sanctions or export-control laws, or if we previously suspended or terminated your account for violating these Terms.

3Geographic availability

The Service is void where prohibited. You must not access or use the Service from a jurisdiction where its availability, sale, or use is prohibited. We may limit, suspend, or discontinue any feature in a geographic area at any time.

Purchases, wallet deposits, and pack rips are currently blocked in the following states:

  • Nevada (NV)
  • Washington (WA)

In plain terms, the current blocked-state list is Nevada and Washington. The list may change. Publication of this list does not mean the Service is lawful in every other jurisdiction, and we do not provide legal advice about your local rules.

4Packs, odds, pools, and card rights

A pack is a digital opening product. Before purchase, the Service displays the pack price, card count, possible value bands, available pool information, and pull probabilities or odds applicable to that pack and the volatility level you select. The displayed information for the specific offer controls over general marketing statements.

Pack results are selected randomly from the published pool according to the displayed odds. A probability is not a promise that a particular card or value will appear in any individual pack or series of packs. Card values are estimates based on available market information at the time shown; they can change and are not appraisals or a guarantee of resale value.

Every revealed card is backed by a real physical card. Subject to availability and verification during fulfillment, we may source or verify the specific physical copy after a pull. A digital inventory entry records your rights concerning the physical card; it is not physical possession. Legal title to a physical card passes to you only after all applicable shipment requirements are met and the properly packaged card is physically handed to and accepted by the carrier for delivery to the address you provided. Purchase, opening, reveal, account allocation, storage, approval of a shipment request, and creation of a shipping label do not by themselves transfer legal title.

Images are used to identify the card and its edition, grade, and condition where applicable. In fulfillment, the specific copy, certification number, or visible characteristics may differ where the Service has disclosed that an image is representative.

5Balance, deposits, and payments

Account balance is limited-use platform credit. It is not cash, a bank deposit, e-money, a payment account, or a general-purpose stored-value product. Balance does not earn interest, is not FDIC-insured, and may not be transferred, assigned, sold, or used outside the Service. Except through a withdrawal feature that we expressly offer and you successfully complete under its own terms, balance and sell-back credit are not redeemable for cash.

When you add funds, you authorize us and our payment processor to charge the payment method you provide. You may use only a payment method you own or are authorized to use, and the name on the account and payment method must match when verification is required. Promotional, referral, bonus, and other courtesy credits have no cash value and may have separate eligibility, use, playthrough, and expiration rules.

6Sell-back

For a card marked eligible in My Vault, THE VAULT offers instant sell-back at 90% of the card’s listed value displayed at the time you confirm. When you confirm, the card leaves your vault and the resulting credit is added to your platform balance. A completed sell-back is final and cannot be reversed.

The listed value is our displayed estimate for that card at that time. Sell-back is a separate transaction with THE VAULT, not a refund of the pack purchase and not a guarantee of the price available anywhere else. We may pause or correct a sell-back where required to address fraud, a manifest pricing or inventory error, a legal hold, or another violation of these Terms, in each case only as permitted by law.

7EVOLVE

EVOLVE lets you submit between two and ten eligible cards from your vault when their combined value meets the minimum shown in the interface. Before you confirm, the Service displays the success probability and the value rule for the possible outcome. The displayed probability is the probability used for that attempt.

Whether the attempt succeeds or fails, every submitted card is consumed and cannot be restored. The resulting card is allocated according to the displayed outcome rule. If any submitted card is still subject to the shipping playthrough described below, the resulting card is also gated and receives a fresh playthrough requirement based on its own value.

8Shipping and delivery

  • You pay the disclosed shipping charge and any insurance you select. Shipping and insurance are charged for each package.
  • A package may contain up to five cards. A request for more than five cards is automatically divided into multiple packages, and each package is charged separately.
  • Shipment requests are processed and handled within 7–10 business days before handoff to the carrier. Carrier transit estimates begin after handoff and are not guaranteed delivery dates.
  • You may cancel or edit a shipment request within 24 hours after placing it, unless it has already been handed to the carrier. Cancellation returns the cards to your vault and refunds the shipping and selected insurance charges for that request. An edit settles only the price difference and does not restart the 24-hour window.
  • You are responsible for a complete and accurate U.S. delivery address. Additional carrier charges caused by an incorrect address, failed delivery, or refusal may be charged as permitted by law.
  • After the carrier scans a package, loss, delay, damage, and other transit claims are handled between you and the carrier under the service and insurance you purchased. THE VAULT is not the carrier and does not guarantee a carrier’s decision. If you did not purchase insurance, recovery may be limited to the carrier’s standard liability.
  • Report a wrong, missing, or damaged item within 10 days after delivery, with your order information and, for damage, photographs. If our investigation confirms a Vault fulfillment error, we will provide an appropriate replacement, credit, or refund as required by law.

9Refunds and chargebacks

A pack purchase is final once the pack is opened or its reveal has begun. An unopened pack that remains eligible in your account may be submitted for a refund request before it is opened, subject to the payment processor’s rules and the status of the account.

We will provide a refund where required by law and in the following circumstances:

  • a duplicate charge;
  • a confirmed technical, software, pricing, inventory, or payment-processing error;
  • an unauthorized or fraudulent charge, after review with the payment processor;
  • we cancel a transaction or cannot fulfill it;
  • a shipment cancellation covered by Section 8; or
  • another circumstance in which we determine a refund is appropriate.

Dissatisfaction with a randomized outcome, the odds or value ranges disclosed before purchase, a later market-value change, or failure to meet a promotion’s stated terms is not by itself a ground for a refund. Shipping and insurance charges are not refundable after the corresponding service has been purchased or performed, except for a timely cancellation or an error described above.

Contact support within 30 days after a disputed charge so we can investigate. Refunds, when approved, may be issued to the original payment method or as platform balance, as allowed by law and the payment processor. You remain responsible for valid transactions made through your account even if your financial institution reverses a charge. If a payment is reversed, we may offset, suspend, or revoke the related unspent credit, unopened pack, or transaction benefit to the extent permitted by law. Fraudulent chargebacks and refund abuse are prohibited conduct.

10Referrals, promo codes, bonus packs, and playthrough

Referrals. Each account may create one referral code and may redeem one referral code, ever. When an eligible referral code is redeemed, both the code owner and the redeeming account earn a free $5 Gym pack, subject to these Terms and any offer-specific rules. An account may redeem a referral code only after it has made at least $10 in cumulative qualifying deposits; welcome grants do not count toward that threshold. Referral rewards obtained through self-referral, duplicate accounts, or other manipulation may be revoked.

Promo codes. Administrator-issued promo codes are not subject to the referral deposit threshold unless the code’s own terms say otherwise. A promo code may have eligibility, one-use, quantity, expiration, and other limits displayed or recorded when it is issued.

Bonus packs. Only paid rips count toward daily, weekly, and monthly bonus ladders; free, referral, promotional, and bonus-pack rips do not count. Periods use your local calendar day, a Monday–Sunday week, and a calendar month. The highest tier reached in a closed period becomes one claimable pack during the following period. The current ladders are: daily — 1 paid rips → Trainer Pack; 3 paid rips → Gym Pack; 5 paid rips → Champion Pack; weekly — 7 paid rips → Trainer Pack; 15 paid rips → Gym Pack; 30 paid rips → Champion Pack; monthly — 20 paid rips → Trainer Pack; 50 paid rips → Gym Pack; 100 paid rips → Champion Pack. An unclaimed bonus expires at the end of its claim period. A daily streak is informational and does not create a separate reward beyond the ladders.

Playthrough. A card pulled from a free, referral, promotional, or bonus pack may ship only after you record paid pack spend after that pull equal to 1.75× the card’s listed value. The playthrough gates shipping only. You may sell back or EVOLVE a gated card at any time. If a gated card is used in EVOLVE, the outcome is gated with a fresh 1.75× requirement based on the outcome’s value.

Free and promotional packs and credits have no cash value, may not be transferred, and may expire or be adjusted for error, fraud, or ineligibility as permitted by law.

11Prohibited conduct and enforcement

You may not:

  • create or operate multiple accounts, share an account, impersonate another person, or provide false identity, age, location, payment, or verification information;
  • use a VPN, proxy, emulator, location-spoofing tool, false address, or any other method to bypass the location gate, age checks, or another eligibility control;
  • use bots, scripts, automation, scraping, or another unauthorized method to purchase, open, price, or interact with packs or the Service;
  • exploit or keep a benefit from a software, pricing, odds, pool, inventory, payment, or promotional error after you know or reasonably should know it is an error;
  • use a payment method you do not own or are not authorized to use, submit a fraudulent chargeback, or engage in money laundering, sanctions evasion, or another unlawful transaction;
  • manipulate referrals, promotions, bonuses, sell-back, EVOLVE, shipping, or account features; or
  • interfere with the security or intended operation of the Service or violate applicable law.

We may investigate suspected violations and, to the extent permitted by law, pause a transaction or shipment, suspend or terminate an account, cancel or reverse a transaction obtained through a violation or manifest error, and freeze or offset an affected balance while the matter is reviewed. We may report unlawful conduct to a payment processor, carrier, regulator, or law-enforcement authority.

12Disclaimers and limitation of liability

To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We do not guarantee uninterrupted availability, that a pool will remain available, or that an estimated card value will be achieved in any later transaction. Nothing in these Terms limits a right or liability that cannot lawfully be limited.

To the maximum extent permitted by law, neither THE VAULT nor its operators, suppliers, or service providers will be liable for indirect, incidental, special, consequential, punitive, or lost-profit damages. Our aggregate liability arising from the Service will not exceed the greater of (a) the total amount you paid to THE VAULT for the Service during the six months before the event giving rise to the claim or (b) US$100. This cap does not apply to amounts we owe you for a completed sell-back, a required refund, willful misconduct, or another liability that cannot lawfully be capped.

13Disputes, arbitration, and governing law

Placeholder: Colorado has been selected as the draft governing law. The final governing-law choice must be confirmed before live launch.

Before starting arbitration or a court claim, contact support with your account email, the transaction involved, a detailed description of the dispute, and the resolution you seek. The parties will try in good faith to resolve the dispute informally for at least 30 days. This step is not required for a qualifying small-claims action or urgent relief needed to prevent imminent harm.

Except for qualifying small-claims actions, disputes arising from or relating to the Service, an account, a pack, a card, sell-back, shipment, payment, or these Terms will be resolved exclusively through binding individual arbitration administered by the American Arbitration Association under its applicable rules. The Federal Arbitration Act governs this arbitration agreement. The arbitrator may decide questions of arbitrability and may award the relief available to an individual in court, subject to these Terms and applicable law.

Arbitration and any permitted court proceeding must be brought individually. Class, consolidated, collective, representative, private-attorney-general, and qui tam actions are waived to the extent permitted by law, and the parties waive a jury trial to the extent permitted by law. If the arbitration agreement is found unenforceable for a dispute, that dispute must be brought in a state or federal court located in Colorado, unless applicable law requires another forum.

If we make a material change to this arbitration section, you may reject that change by sending written notice within 30 days after notice of the change and stopping use of the Service; the prior arbitration terms will then apply to disputes that arose before the change, to the extent permitted by law.

14General

These Terms and any offer-specific rules are the entire agreement between you and us concerning the Service. If a provision is found unenforceable, the remaining provisions continue in effect, and the unenforceable provision will be limited to the minimum extent necessary. Our failure to enforce a provision is not a waiver. You may not assign your account or these Terms; we may assign them in connection with a sale, merger, reorganization, or transfer of the Service, subject to applicable law.

Headings are for convenience only. Sections concerning card rights, payments, refunds, prohibited conduct, liability, disputes, and other provisions that by their nature should survive will survive termination.
